Bu Kullanım Koşulları ("Koşullar"), CC Kalıp İskele Yazılım ve Medya A.Ş. (MERSİS: 0465086578200001, Vergi Dairesi/No: Kozyatağı V.D. / 4650865782; bundan böyle "Şirket", "biz") tarafından işletilen yaraticiortak.com web sitesi ve Yaratıcı Ortak hizmetlerinin ("Hizmet") kullanımına ilişkin şart ve koşulları düzenler. Hizmete erişerek veya Hizmeti kullanarak bu Koşulları okuduğunuzu, anladığınızı ve kabul ettiğinizi beyan edersiniz. Koşulları kabul etmiyorsanız Hizmeti kullanmayınız.These Terms of Service ("Terms") govern the use of the yaraticiortak.com website and the Yaratıcı Ortak services (the "Service") operated by CC Kalıp İskele Yazılım ve Medya A.Ş. (MERSIS: 0465086578200001, Tax Office/No: Kozyatağı T.O. / 4650865782; the "Company", "we"). By accessing or using the Service, you acknowledge that you have read, understood and accepted these Terms. If you do not accept these Terms, do not use the Service.

1. Hizmet Tanımı1. Description of Service

Yaratıcı Ortak, kullanıcıların dijital içerik (görsel, metin ve benzeri yaratıcı çıktı) üretmesine yardımcı olan, bulut tabanlı bir dijital üretim ve yaratıcı ortaklık hizmetidir. Hizmet, abonelik ve/veya kredi/paket bazlı olarak sunulur. Şirket, Hizmetin kapsamını, özelliklerini ve fiyatlandırmasını önceden bildirimde bulunarak güncelleme hakkını saklı tutar.Yaratıcı Ortak is a cloud-based digital production and creative-partner service that helps users generate digital content (images, text and similar creative output). The Service is offered on a subscription and/or credit/package basis. The Company reserves the right to update the scope, features and pricing of the Service with prior notice.

2. Hesap ve Kayıt2. Account and Registration

Hizmetin belirli özelliklerinden yararlanmak için hesap oluşturmanız gerekebilir. Kayıt sırasında doğru, güncel ve eksiksiz bilgi vermeyi kabul edersiniz. Hesap kimlik bilgilerinizin gizliliğinden ve hesabınız altında gerçekleşen tüm faaliyetlerden siz sorumlusunuz. Yetkisiz bir kullanım fark ettiğinizde derhal bizi bilgilendirmelisiniz.You may need to create an account to use certain features of the Service. During registration you agree to provide accurate, current and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately upon becoming aware of any unauthorized use.

• Hesap tek bir gerçek veya tüzel kişiye aittir; devredilemez.An account belongs to a single natural or legal person and is non-transferable.
• 18 yaşından küçük kullanıcılar Hizmeti veli/vasi onayı olmaksızın kullanamaz.Users under the age of 18 may not use the Service without parental/guardian consent.

3. Ödeme ve Abonelik3. Payment and Subscription

Ücretli paket ve abonelikler, ödeme adımında gösterilen ve KDV dahil Türk Lirası cinsinden belirtilen fiyatlar üzerinden satılır. Ödemeler, PCI-DSS uyumlu iyzico güvenli ödeme altyapısı üzerinden kredi/banka kartı ile tahsil edilir. Kart bilgileriniz Şirket tarafından görülmez ve saklanmaz. Abonelikler, iptal edilmedikçe seçtiğiniz dönem sonunda güncel tarife üzerinden otomatik yenilenebilir; yenileme öncesi bilgilendirilirsiniz.Paid packages and subscriptions are sold at the prices shown at the payment step, stated in Turkish Lira including VAT. Payments are collected by credit/debit card through the PCI-DSS compliant iyzico secure payment infrastructure. Your card details are not seen or stored by the Company. Unless cancelled, subscriptions may renew automatically at the end of the selected period at the then-current rate; you will be informed before renewal.

Elektronik ortamda anında ifa edilen dijital içerik/hizmetlerde, Mesafeli Sözleşmeler Yönetmeliği m.15/1-ğ uyarınca ifaya başlanmasıyla cayma hakkı kullanılamaz. Ayrıntı için İade Koşulları ve Mesafeli Satış Sözleşmesi sayfalarına bakınız.For digital content/services performed instantly online, the right of withdrawal cannot be exercised once performance has begun, pursuant to Article 15/1-ğ of the Distance Contracts Regulation. 4. Kabul Edilebilir Kullanım4. Acceptable Use

Hizmeti kullanırken aşağıdakileri yapmamayı kabul edersiniz:When using the Service, you agree not to:

• Yürürlükteki mevzuata, üçüncü kişilerin haklarına (telif, marka, kişilik hakları dahil) aykırı içerik üretmek veya yaymak;generate or distribute content that violates applicable law or the rights of third parties (including copyright, trademark and personality rights);
• Hizmeti kötü amaçlı yazılım dağıtımı, dolandırıcılık, taciz, nefret söylemi veya yasa dışı amaçlar için kullanmak;use the Service to distribute malware, or for fraud, harassment, hate speech or any unlawful purpose;
• Hizmetin altyapısına yetkisiz erişim sağlamaya çalışmak, tersine mühendislik yapmak veya otomatik/aşırı yükleme ile sistemi bozmak;attempt unauthorized access to the Service infrastructure, reverse engineer it, or disrupt it through automated/excessive load;
• Hizmeti yeniden satmak veya Şirketin yazılı izni olmadan ticari olarak yeniden dağıtmak.resell the Service or commercially redistribute it without the Company's written permission.

Kullanıcı tarafından üretilen içeriğin hukuka uygunluğundan kullanıcı sorumludur. Şirket, bu Koşulları ihlal eden içerik ve hesapları askıya alma veya kaldırma hakkını saklı tutar.The user is responsible for the lawfulness of user-generated content. The Company reserves the right to suspend or remove content and accounts that violate these Terms.

5. Fikri Mülkiyet5. Intellectual Property

Hizmet, web sitesi, arayüz, yazılım, marka, logo ve tüm bileşenlere ilişkin fikri ve sınai mülkiyet hakları Şirkete veya lisans verenlerine aittir. Yürürlükteki mevzuatın izin verdiği ölçüde, ürettiğiniz çıktılar üzerindeki kullanım haklarınız ödeme ve abonelik koşullarınıza tabidir. Şirket markaları ve içeriği, önceden yazılı izin olmaksızın kopyalanamaz veya kullanılamaz.All intellectual and industrial property rights in the Service, website, interface, software, brand, logo and all components belong to the Company or its licensors. To the extent permitted by applicable law, your rights to use the output you generate are subject to your payment and subscription terms. The Company's marks and content may not be copied or used without prior written permission.

6. Sorumluluğun Sınırlandırılması6. Limitation of Liability

Hizmet "olduğu gibi" ve "mevcut haliyle" sunulur. Yürürlükteki emredici hükümler saklı kalmak kaydıyla Şirket; Hizmetin kesintisiz, hatasız veya belirli bir amaca uygun olacağını garanti etmez. Şirket, dolaylı, arızi, özel veya sonuç niteliğindeki zararlardan sorumlu değildir. Şirketin toplam sorumluluğu, her hâlükârda, ilgili talebe konu olay öncesindeki son on iki (12) ay içinde ilgili kullanıcı tarafından Hizmet için ödenen toplam tutarla sınırlıdır. Bu sınırlama, tüketici mevzuatından doğan haklarınızı etkilemez.The Service is provided "as is" and "as available". Without prejudice to mandatory provisions of applicable law, the Company does not warrant that the Service will be uninterrupted, error-free or fit for a particular purpose. The Company shall not be liable for indirect, incidental, special or consequential damages. The Company's total liability shall in any case be limited to the total amount paid for the Service by the relevant user in the twelve (12) months preceding the event giving rise to the claim. This limitation does not affect your rights arising from consumer legislation.

7. Fesih ve Askıya Alma7. Termination and Suspension

Aboneliğinizi hesap ayarlarından veya bizimle iletişime geçerek dilediğiniz zaman iptal edebilirsiniz; iptal, ödediğiniz dönemin sonunda geçerli olur. Şirket, bu Koşulların ihlali, yasa dışı kullanım veya güvenlik gerekçeleriyle Hizmete erişiminizi askıya alabilir ya da sonlandırabilir. Fesih hâlinde, yürürlükteki mevzuat ve iade koşulları çerçevesindeki haklarınız saklıdır.You may cancel your subscription at any time from your account settings or by contacting us; cancellation takes effect at the end of the paid period. The Company may suspend or terminate your access to the Service for breach of these Terms, unlawful use or security reasons. Upon termination, your rights under applicable law and the refund terms are reserved.

8. Değişiklikler8. Changes

Şirket, bu Koşulları zaman zaman güncelleyebilir. Önemli değişiklikler web sitesi üzerinden duyurulur ve yürürlük tarihi güncellenir. Değişiklikten sonra Hizmeti kullanmaya devam etmeniz, güncel Koşulları kabul ettiğiniz anlamına gelir.The Company may update these Terms from time to time. Material changes will be announced on the website and the effective date updated. Continuing to use the Service after a change means you accept the updated Terms.

9. Uygulanacak Hukuk ve Uyuşmazlık Çözümü9. Governing Law and Dispute Resolution

Bu Koşullar Türkiye Cumhuriyeti hukukuna tabidir. Tüketici işlemlerinde, Ticaret Bakanlığı'nca ilan edilen parasal sınırlar dahilinde tüketicinin yerleşim yerindeki Tüketici Hakem Heyetleri ve Tüketici Mahkemeleri yetkilidir. Diğer uyuşmazlıklarda Türkiye Cumhuriyeti mahkemeleri ve icra daireleri yetkilidir.These Terms are governed by the laws of the Republic of Türkiye. For consumer transactions, the Consumer Arbitration Committees and Consumer Courts at the consumer's place of residence are competent within the monetary limits announced by the Ministry of Trade. For other disputes, the courts and enforcement offices of the Republic of Türkiye are competent.
