Bu Son Kullanıcı Lisans Sözleşmesi ("EULA"), CC Kalıp İskele Yazılım ve Medya A.Ş. (MERSİS: 0465086578200001, Kozyatağı V.D. / 4650865782; "Lisans Veren", "Şirket") ile Yaratıcı Ortak yazılımını ve hizmetini kullanan son kullanıcı ("Lisans Alan", "siz") arasında akdedilmiştir. Yazılımı veya Hizmeti kullanarak bu EULA'yı kabul etmiş sayılırsınız.This End-User License Agreement ("EULA") is concluded between CC Kalıp İskele Yazılım ve Medya A.Ş. (MERSIS: 0465086578200001, Kozyatağı T.O. / 4650865782; the "Licensor", "Company") and the end user of the Yaratıcı Ortak software and service (the "Licensee", "you"). By using the software or the Service, you are deemed to have accepted this EULA.

1. Lisansın Kapsamı1. Scope of License

Bu EULA kapsamında Lisans Veren, size Yaratıcı Ortak yazılımını ("Yazılım") ve ilgili hizmeti; kişisel veya iç ticari amaçlarınız için, münhasır olmayan (non-exclusive), devredilemez (non-transferable), dünya çapında ve geri alınabilir bir lisans ile kullanma hakkı tanır. Yazılım size satılmaz, yalnızca lisanslanır. Lisans, geçerli abonelik veya kredi/paket koşullarınızın devam ettiği süre boyunca geçerlidir.Under this EULA, the Licensor grants you a non-exclusive, non-transferable, worldwide and revocable license to use the Yaratıcı Ortak software (the "Software") and the related service for your personal or internal business purposes. The Software is licensed, not sold. The license remains valid for as long as your active subscription or credit/package terms continue.

2. Kullanım Hakları2. Usage Rights

• Yazılımı, bu EULA ve Kullanım Koşulları çerçevesinde kullanabilirsiniz.You may use the Software within the framework of this EULA and the Terms of Service.
• Yürürlükteki mevzuatın izin verdiği ölçüde, Yazılım aracılığıyla ürettiğiniz çıktıları, ödeme koşullarınıza tabi olarak kullanabilirsiniz.To the extent permitted by applicable law, you may use the output you generate through the Software, subject to your payment terms.
• Üçüncü kişi haklarını ihlal etmeyen, hukuka uygun çıktı üretmekten yalnızca siz sorumlusunuz.You alone are responsible for producing lawful output that does not infringe third-party rights.

3. Kısıtlamalar3. Restrictions

Aşağıdakiler açıkça yasaktır:The following are expressly prohibited:

• Yazılımı kopyalamak, çoğaltmak, kiralamak, ödünç vermek, alt lisanslamak veya üçüncü kişilere dağıtmak;copying, reproducing, renting, lending, sublicensing or distributing the Software to third parties;
• Yazılımı tersine mühendislik yapmak, kaynak koduna dönüştürmek (decompile), parçalarına ayırmak (disassemble) — mevzuatın açıkça izin verdiği hâller hariç;reverse engineering, decompiling or disassembling the Software — except where expressly permitted by law;
• Yazılım üzerindeki telif, marka veya mülkiyet bildirimlerini kaldırmak veya değiştirmek;removing or altering any copyright, trademark or proprietary notices on the Software;
• Yazılımı, güvenlik önlemlerini aşacak, sisteme zarar verecek veya hizmet dışı bırakacak şekilde kullanmak.using the Software in a way that circumvents security measures, damages the system or causes a denial of service.

4. Fikri Mülkiyet4. Intellectual Property

Yazılım ve tüm bileşenlerine (kaynak kodu, arayüz, tasarım, marka, logo, dokümantasyon dahil) ilişkin tüm fikri ve sınai mülkiyet hakları münhasıran Lisans Verene veya lisans sağlayıcılarına aittir. Bu EULA, size Yazılım üzerinde mülkiyet hakkı değil, yalnızca sınırlı bir kullanım lisansı verir. Bu EULA'da açıkça tanınmayan tüm haklar Lisans Verende saklıdır.All intellectual and industrial property rights in the Software and all its components (including source code, interface, design, brand, logo and documentation) belong exclusively to the Licensor or its licensors. This EULA grants you only a limited license to use, not ownership of, the Software. All rights not expressly granted in this EULA are reserved by the Licensor.

5. Garanti Reddi5. Disclaimer of Warranty

Yazılım ve Hizmet "OLDUĞU GİBİ" ve "MEVCUT HALİYLE" sunulur. Yürürlükteki emredici hükümler saklı kalmak kaydıyla, Lisans Veren; Yazılımın kesintisiz veya hatasız çalışacağına, belirli bir amaca uygunluğuna veya ürettiği çıktının doğruluğuna ilişkin açık ya da zımni hiçbir garanti vermez. Yapay üretim/otomatik üretim çıktıları hata içerebilir; kullanmadan önce kontrol etmek Lisans Alanın sorumluluğundadır.The Software and the Service are provided "AS IS" and "AS AVAILABLE". Without prejudice to mandatory provisions of applicable law, the Licensor gives no express or implied warranty that the Software will operate uninterrupted or error-free, of fitness for a particular purpose, or as to the accuracy of the output it produces. Generated/automated output may contain errors; it is the Licensee's responsibility to review it before use.

6. Sorumluluğun Sınırlandırılması6. Limitation of Liability

Yürürlükteki emredici hükümler saklı kalmak kaydıyla, Lisans Veren; Yazılımın kullanımından doğan dolaylı, arızi, özel veya sonuç niteliğindeki zararlardan sorumlu tutulamaz. Lisans Verenin toplam sorumluluğu, ilgili talepten önceki son on iki (12) ay içinde Yazılım/Hizmet için ödediğiniz toplam tutarla sınırlıdır. Bu sınırlama, tüketici mevzuatından doğan haklarınızı etkilemez.Without prejudice to mandatory provisions of applicable law, the Licensor shall not be liable for indirect, incidental, special or consequential damages arising from use of the Software. The Licensor's total liability is limited to the total amount you paid for the Software/Service in the twelve (12) months preceding the relevant claim. This limitation does not affect your rights arising from consumer legislation.

7. Lisansın Sona Ermesi7. Termination of License

Bu EULA'yı ihlal etmeniz hâlinde lisansınız otomatik olarak sona erer. Lisans Veren, ihlal, yasa dışı kullanım veya güvenlik gerekçeleriyle lisansı askıya alabilir veya feshedebilir. Lisansın sona ermesiyle Yazılımı kullanma hakkınız biter; ancak bu EULA'nın niteliği gereği yürürlükte kalması gereken hükümleri (fikri mülkiyet, sorumluluk sınırı, uyuşmazlık) geçerliliğini korur.Your license terminates automatically if you breach this EULA. The Licensor may suspend or terminate the license for breach, unlawful use or security reasons. Upon termination, your right to use the Software ends; however, provisions of this EULA that by their nature must survive (intellectual property, limitation of liability, disputes) remain in force.

8. Uygulanacak Hukuk8. Governing Law

Bu EULA, Türkiye Cumhuriyeti hukukuna tabidir. Tüketici işlemlerinde tüketicinin yerleşim yerindeki Tüketici Hakem Heyetleri ve Tüketici Mahkemeleri; diğer uyuşmazlıklarda Türkiye Cumhuriyeti mahkemeleri ve icra daireleri yetkilidir.This EULA is governed by the laws of the Republic of Türkiye. For consumer transactions, the Consumer Arbitration Committees and Consumer Courts at the consumer's place of residence; for other disputes, the courts and enforcement offices of the Republic of Türkiye are competent.
